2. Terms & Conditions of Sale and Rental

2.1 Scope

These terms apply to all quotes, bookings, catering services and cart rentals provided by MHA Collective ("Gara Coffee"). By confirming a booking, the client accepts these terms.

2.2 Quotes and booking

• Quotes are valid for 30 days from the date of issue.
• A booking is confirmed only upon written confirmation (email accepted) by MHA Collective and, where applicable, receipt of the deposit.

2.3 Prices and payment

• All prices are in Swiss francs (CHF). Prices do not include VAT, as MHA Collective is not VAT-registered (annual turnover below CHF 100,000).
• A deposit of 50% of the agreed price is due upon booking confirmation. The balance of 50% is invoiced after the event and payable within 14 days.
• Accepted payment method: bank transfer (details on the invoice).
• Late payment: statutory default interest under Art. 73 OR may be charged.

2.4 Cancellation and postponement

• Cancellation by the client more than 14 days before the event: deposit refunded in full.
• Cancellation 14 days or fewer before the event: 50% of the agreed price is due.
• Postponement is possible once, subject to availability, at no charge if notified more than 14 days in advance.

2.5 Cart rental (self-run)

• The rented cart and its equipment remain the property of MHA Collective.
• The client uses the equipment at their own risk and is responsible for its safe operation and for compliance with local food-safety rules during the rental period.
• The client is liable for damage, loss or excessive soiling beyond normal use, at replacement or repair cost.
• The cart must be returned in the condition received; otherwise cleaning costs may be charged.

2.6 Liability

• Gara Coffee is liable only for direct damage caused by intent or gross negligence, to the extent permitted by Swiss law (Art. 100 OR).
• Gara Coffee is not liable for indirect or consequential damage, nor for the client's use of rented equipment.

2.7 Applicable law and jurisdiction

Swiss law applies exclusively. Place of jurisdiction is Marly (canton Fribourg), Switzerland, subject to mandatory consumer-protection provisions.

3. Privacy Policy

3.1 Who processes your data

MHA Collective, Allée des Chênes 1, 1723 Marly, Switzerland ("we"), is responsible for the processing of personal data on this website within the meaning of the Swiss Federal Act on Data Protection (revDSG) and, where applicable, the EU GDPR.

3.2 What we collect

• Quote form: name, email, phone (optional), company (optional), event date and location, and the content of your message. We use this data only to answer your request and prepare your quote.
• Order data: if you book, we keep the information needed to deliver the service and issue invoices (name, address, contact, booking details).
• Server logs: our hosting provider (Infomaniak, Switzerland) automatically logs technical access data (IP address, time, requested page) for security purposes. Logs are deleted after 30 days.

3.3 Why we may process it (legal basis)

• To answer your quote request and perform our contracts with you (contract performance).
• To comply with legal obligations such as accounting retention (legal obligation).
• To secure our website (legitimate interest).

3.4 Sharing, storage and retention

• We do not sell or share your data with third parties for marketing.
• Data is stored on servers located in Switzerland (hosting: Infomaniak, La Tour-de-Peilz). We use no newsletter or third-party marketing tools.
• Accounting and transaction records (quotes, contracts, invoices) are kept for 10 years, as required by Swiss law (Art. 958f OR / Art. 131 StHG).
• Other personal data (e.g. quote requests that do not lead to a booking) is deleted or irreversibly anonymised after 12 months. Anonymised statistics (e.g. number of requests per canton) may be kept to improve our services.

3.5 Cookies and analytics

This website uses only strictly necessary cookies and does not use advertising or tracking cookies, nor third-party analytics. No consent banner is therefore required under the revDSG.

3.6 Marketing contact

If you ask us to keep you informed (e.g. about seasonal offers), we keep your contact details for that purpose until you unsubscribe. You can opt out at any time via the same channel.

3.7 Your rights

You may request access to, correction of or deletion of your personal data, object to certain processing, and lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC). Requests can be sent to info@garacoffee.ch — we respond within 30 days.
